I I 摘 要 行政公益诉讼理论日益成熟，而我国工会维权手段的效力却逐渐减弱，尤其 是面对行政行为的侵害时，维权力量更显得苍白无力。那么怎样运用行政诉讼这 一救济手段，切实的发挥维护职工合法权益的职能，对于在行政权力不断扩大的 今天有着重要意义。为此，本文所要关注和研究的是：在目前较为成熟的行政公 益诉讼理论的支撑下，如何赋予工会原告资格。 整篇文章分为五个部分：第一部分从理论分析入手，提出了工会以原告资格 提起行政公益诉讼的法理基础是权利社会化与原告资格范围扩大。在方法论基础 上，文章从多元法益主体框架与利益衡量法角度论证了赋予基于行政公益诉讼的 工会原告资格的可行性。 第二部分，文章结合行政诉讼原告资格发展的实际情况，以及目前我国工会 维权的现状与未来工会运动的发展趋势，从实践意义上论证了赋予工会行政公益 诉讼原告资格的实践价值。 第三、四部分，论述了工会以原告资格提起行政公益诉讼在立法、司法和工 会自身方面所遇到的障碍，并在此基础上提出了相应的完善对策。 最后一部分，文章对这一制度在实务操作中可能遇到的问题进行了设计。主 要是关于公益的界定、此类案件类型、防止滥诉、举证责任的分配、诉讼费用的 承担。 关键词：行政公益诉讼 原告资格 工会 II II Abstract As the theory of public welfare litigation more mature, but the means of defending rights for labor union have gradually weakened, especially was offended by the administrative, so how to use public welfare litigation and how to protect the workers’ rights are very important today, so the theme of this thesis focuses on: under the support of theory of public welfare litigation, how to give the plaintiff qualification. The thesis is divided into five parts: the first part begins form the theoretical analysis, highlights that the legal basis of the public welfare litigation is the expansion of rights socialization and the scope of plaintiff’s qualification. On the basis of theoretical methodology, the thesis proves the application of plaintiff’s qualification of labor union from two aspects: multiple legal interests. In the second part, combined with practical development situation of plaintiff ’s qualification in the public welfare litigation and the development trends of labor union activities, the thesis proves the practical value of plaintiff ’s qualification. In the third and forth part, the thesis discusses the obstacles in the legislation and justice when the labor union brings into legal actions, propose the measures to complete at the same time. In the last part, the thesis discusses the problems when the system is implemented. It is abort the definition of public welfare, the type, anti about of litigation, the distribution
