PAGE PAGE 1 毕业论文（设计） 题目 消防应急管理原则研究 学 号 姓 名 系 队 专 业 指导教师 二00八年六月 本科毕业论文（设计） PAGE IV 摘 要 我国公安消防部队作为24小时备勤的现役制灭火和应急抢险救援专业力量，近年来已成为国家处置各类灾害事故的主要力量。为了更好、更快的处置各类灾害事故，需要给消防部门配置一些特殊的应急管理权力。然而，如果不对消防应急管理权力加以限制，就有可能导致权力的滥用，给人民生命财产造成不必要的损失。本文通过参考国内外专家学者对突发事件应对法的研究成果以及我国行政法等内容，紧密结合我国消防应急管理的特征，认真分析了当前消防应急管理中存在的问题，对消防应急管理原则进行了探讨、分析，提出合法性原则、应急性原则、基本权利保障原则、比例原则等一些行之有效的消防应急管理原则。尤其是在基本权利保障原则中提出了保障应急处置参与人员安全的问题，避免了过去重勇敢轻科学的现象。同时，比例原则使消防部队在处置灾害事故时更注重利益的衡量、注重效率，防止重目标轻过程、重结果轻效率的现象发生。这些原则能有效地规范消防应急管理权力，保障公民、社会组织的合法权益，对降低消防应急管理成本，提高消防应急管理效率，更好的发挥消防部队在灭火和抢救人命为主的各类灾害事故中的作用都有重要意义。 关键词 消防管理； 应急管理； 原则 The fire fight meet an emergency a management principle a research Abstract: In China Public security Fire prevention Army takes the active duty system fire fighting which and the emergency rescue specialized strength 24 hours prepare to go on duty, in recent year sit has become the country to handle each kind of disaster accidents main strength, to be better and quicker handling each kind of disaster accident, needs to give the Fire service to dispose some special emergency management authority, however, if does not limit to the fire emergency management authority, has the possibility to cause the authority abusiveness, the life and property causes the nonessential losses for the people.
