·医药热点· 超说明书用药的现状及其法律风险 1＊ 1 1 2 1# 唐 蕾 ，韦炳华 ，何秋毅 ，甘翌晓 ，张武军 （1. 中山大学附属第一医院药学部，广州 510080；2.广州金鹏律 师事务所，广州 510000） 中图分类号 R95 文献标志码 A 文章编号 1001-0408（2014）45-4225-04 DOI 10.6039/j.issn. 1001-0408.2014.45.01 摘 要 目的：推动超说明书用药立法，以保障超说明书用药的规范性与合法性。方法：对目前国内外超说明书用药现状及立法 情况、潜在危害、法律风险及国内因超说明书用药而引发的医疗纠纷案例等进行分析。结果与结论：超说明书用药的现象在临床 上普遍存在，但对于超说明书用药的合理性与规范性，只有部分国家在法律层面明确规定是否允许超说明书用药；在国内，各方还 缺乏统一的认识，更缺乏明确的法律依据，绝大部分超说明书用药管理规定仅仅是医院内部的规章制度及不具有法律效力的行业 专家共识；涉及超说明书用药纠纷案时，《中国药典》、药品说明书、《临床诊疗指南》及《临床技术操作规范》等是法律判定的主要参 考依据，除此之外的超说明书用药则是医疗过错判定的依据。故我国目前超说明书用药缺乏法律基础，医务人员需谨慎对待超说 明书用药的法律风险。建议有关各方积极推动立法，为超说明书用药提供法律保障。 关键词 超说明书用药；现状；法律风险；立法 Situation and Legal Risk of Off-label Drug Use 1 1 1 2 1 TANG Lei ，WEI Bing-hua ，HE Qiu-yi ，GAN Yi-xiao ，ZHANG Wu-jun （1.Dept. of Pharmacy ，The First Affiliat- ed Hospital ，Sun Yat-Sen University ，Guangzhou 510080，China ；2.Guangzhou Jinpeng Law Firm ，Guangzhou 510000，China ） ABSTRACT OBJECTIVE ：To promote the legislation of off-label drug use ，and to ensure the normalization and legitimacy of off-label drug use. METHODS ：The foreign and domestic off-label drug use was analyzed in terms of situation ，legislation ，poten- tial hazard and legal risk ，and medical dispute caused by off-label drug use was also analyzed. RESULTS CONCLUSIONS ：The off-label drug use is very common in clinical practice ，but only a few countries set up the definite legal regulation of off-label drug use in respect of normalization and legitimacy. In China ，all parties lack of unified understanding ，and definite legal support is also absent ；most of off-label drug use regulations are just hospital regulations and systems and industry expert consensus without legal effect.
