集芙丈曇 JIMEI UNIVERSITY 毕业论文 题目 水上交通肇事罪的立法探析 以4. 18案为例 学院 法学院 年级 2012级 姓名 付世阳 指导老师 孟媛媛 专业 法学（海商法方向） 班级 1215 学号 201221163040 职称 2016年4月 水上交通肇事罪的立法探析 ——以4. 18案为例 ［扌商要］ 随着世界经济的发展，全球化的不断加剧，各国对于交通运输的需求与日 俱增，海运以其运费低、运量大的特点，顺其自然的受到各国的重视。但在海运行业繁 荣昌盛的同吋，水上交通事故也在频繁的发生，对公民的生命、健康和财产权利产生了 极大的威胁。但我国目前的做法大都以民事责任或者行政责任追究肇事者，只有极少数 被追究刑事责任，这不仅使受害方得不到安慰，也起不到对水上交通事故的有效预防和 惩戒的作用。本文以水上交通肇事的特点和法益保护的需要参照现行刑法关于铁路和航 空交通责任事故犯罪的处理模式，单独设立“水上交通肇事罪”，细化定罪量刑的标准, 特别是“人员失踪”的问题，并对该罪设立的必要性和可行性进行分析，以此弥补我国 关于水上交通事故的立法缺陷，有效的预防和减少水上交通事故的发生，保障水上交通 运输的安全，促进航运业的健康发展。 ［关键i司］交通肇事罪 水上交通事故 立法构建 The Legislation of the Crime of Causing Traffic Casualties on the Water Abstract With the development of the world economy, the increasing of the globalization, the demand of transportation is increasing day by day, the ocean freight is low and the volume of freight is big. But at the same time, the marine industry is thriving, water traffic accidents occur frequently, and the citizens lives, health and property rights have been a great threat. But Chinas current practice mostly to civil responsibility or administrative responsibility to hold the perpetrators, only a handful of be held criminal responsibility, which not only makes the injured party is not to comfort, but there is no effective prevention of water traffic accident and disciplinary role. This paper to the needs of water traffic accident characteristics and protection of the interests of the law with ref ere nee to the existing criminal law on the rail and air traffic liability accident crime processing mode, and set up a separate Hwater traffic accident crime： refine the conviction and sentencing standards, especially missing persons； and for the crime set up the necessity and feasibility analysis, in order to make up for our country about the legislative defects of the aquatic traffic accident, can effectively prevent and reduce the occurrenee of traffic accidents on the water, to ensure the safety of water transportation, promote the healthy development
