PAGE 20 历史文化名城保护与城市化发展：利益与制度博弈 ——浙江定海历史文化名城保护事件透析 徐家良 汪锦军 李继刚 北京天则经济研究所“政府体制改革”研究项目子课题 “历史文化名城保护与城市化发展”最终研究成果 [内容提要] 在城市化发展过程中，经济建设与历史文化名城保护往往会引发冲突与矛盾，使人们在建设与保护之间不得不作出两难抉择。浙江省舟山市定海历史文化名城保护事件从一个侧面反映出政府官员在政绩驱动与经济利益驱动下制度规范逐渐蜕变成软约束，使利益与制度博弈关系出现错位，引发历史文化名城受到大规模破坏的严重后果。因此，有必要重新构建利益与制度博弈关系，通过利益动力机制和制度动力机制的合理配置，确保正当利益的维护和制度的有效供给，既做到历史文化名城的良好保护，又能促进城市化的正常发展，实现社会文化与经济的可持续发展目标。 [关 键 词] 历史文化名城保护 利益驱动 制度软约束 博弈 动力机制配置 Protection of Historical and Cultural Cities and Development of Urbanization: A Game Between Interests and Institutions ——A Case on the Incident of Protection of Historical and Cultural Cities at Dinghai District Zhejiang Province Xu jia liang [Abstract] The process of urbanization is easy to evoke contradiction between economic construction and protection of historical and cultural cities, it is a dilemma. An incident , protection of historical and cultural cities at Dinghai District Zhejiang Province, embody it is a dislocation between interests and institutions with political outstanding achievement drive and economic interests drive. So, it made historical and cultural cities destroy at big scope. For the sake of setting a kind of new relations about law of market economic development and modernization strategy of rule by law between interests and institutions, it is necessary to rearrange interests impetus mechanism and institutions impetus mechanism, pledging impetus resources between interests demand and institutions supply, taking some public policies, such as changing political outstanding achievement value criterion, making law of protection historical and cultural cities, raising citizens’ and local government leaders’ consciousness of protection historical and cultural cities etc. It needs to solve conflict between individual reason and collective reason, keeping good protection of historical and cultural cities, at the some time, improving development of urbanization.
