人格权独立成编研究 摘要 我国各种人身权利学说一直在继承中发展，但比较系统的人身权没有完全建立。因此，十分必要展开对人格权的研讨，继以推动中国法制化进程，并通过法律来对公民的切身利益加以有效保护。在民法典中，单独把人格权编排成一个体系的问题，学界司法界存在着较大争议。主要是：王利明教授与梁慧星教授的观点不一致，在人格权独立成编立法保护及立法模式上存在肯定说与否定说上的分歧。本文拟从人格权独立成编观点研究归纳，相关研究分析，主要内容初探，并兼顾其他，着重阐述在民法典中单独把人格权编排成一个体系的重要性，并结合我国民法总则实施情况，指出将来中国民法典中各种人身权利学说独立成编理想下的内容选定。 关键词：人格权；独立成编；民法；立法体系 Abstract China’s personality right theory is still not fully established, so it is necessary to study the right of personality, so as to effectively promote the process of legalization China, by law for the interests of the citizens for the protection of the law. The question of whether the right of personality should be independent has been debated for a long time. Experts and academics in China launched a debate about our country civil code of pattern design, the argument is mainly lies in whether the personality right should be independent to make up, both sides hold different points of view, in support of the independent personality right into academic experts headed by professor wang liming, they think the personality right should not be stipulated in civil code general provisions, also cannot be classified as the act of tort, but in separate. However, some scholars held that the right of personality should belong to the chapter of ”natural person” in the general principles of civil code. Therefore this paper carried out detailed analysis for the two kinds of argument, and for the present study is carried out detailed analysis on a series of human rights law necessity alone in civil law, combine the general introduction of civil law to carry on the discussion, put forward an independent personality right under the assumption of the content selection.
