皖西学院本科毕业论文（设计） 第 PAGE 9页 浅谈商标类似 作 者 李德胜 指导教师 台启珍 摘要： 生产者、经营者在其 生产、 制造、 加工、拣选或者经销的商品上或者服务的提供者在其提供的服务上采用的商标具有显著特征的 标志，是现代 经济的 产物。商标通过确保商标注册人享有用以标明商品或服务，或者许可他人使用以获取报酬的专用权，而使商标注册人受到保护。但是目前各种侵犯注册商标专用权的行为层出不穷，类似以“搭便车”、“傍名牌”为手段的商标类似侵权行为不断见诸报端；这种行为严重侵犯了商标权利人和消费者的合法权益，具有极大的危害性。尽管我国的《商标法》明确规定在相同或者类似商品上使用与注册商标相近似的商标的行为构成商标侵权，但是对商标类似如何认定目前尚无明确的规定，导致目前判断商标类似成为一大难点。本文将对商标类似形式、商标类似认定方法进行探讨。 关键词：商标 商标类似 混淆 近似形式 认定方法 On The Similar Trademark Abstract:Producers, operators in their production, manufacture, processing, picking, or distribution of goods or services on offer in the services provided on the use of its trademarks with the salient features of the logo, is a product of the modern economy.
