共享汽车的责任承担问题 摘 要 共享汽车是区别于传统出租车行业的新兴业态，其是共享经济的一部分， 在共享经济模式下，由于法律的滞后性等特点，在共享汽车的相关领域法律几 乎是“一片空白”，如何完善相关的法律法规，是促进共享汽车行业发展根本 要求。本文从五个部分分析：第一部分主要介绍共享汽车的概念、国内外发展 状况及其发展的意义，为研究该课题做基本了解；第二部分主要介绍我国共享 汽车发展模式及其法律关系，主要包括共享实物模式、共享信息模式两部分部 分；第三部分介绍共享汽车中的侵权责任问题及侵权责任认定；第四部分主要 介绍如何保障共享汽车经营者与用户承担自己的责任，主要从确立归责原则与 保险制度、严格规制合同诈骗行为两部分分析，第五部分主要是本人对如何完 善共享汽车租赁制度的建议，提出了一些自己的见解。 关键词：共享汽车 共享实物模 共享信息模 侵权责任问题 责任承担 Abstract Shared car is a new form of industry which is different from the traditional taxi industry. It is part of the shared economy. Under the shared economic model, due to the lag of law and so on, the law is almost blank in the related fields of sharing the automobile. How to improve the relevant laws andregulations is to pro mote the development of the sharing car industry. This is the request. Thisarticle is divided into five main parts: the first part mainly introduces the concept of shared vehicle, the status of domestic and foreign development and the significance of its development, and the basic understanding of the research on this subject. The second part mainly introduces the development mode and legal relationship of shared vehicle in China, including the sharing of physical model and the sharing of information mode in two parts. The third part introduces the tort liability in the shared car and the identification of the tort liability; the fourth part mainly introduces how to guarantee the responsibility of the shared car operators and users, mainly from the two parts of theanalysis of the principle of liability and the in surance system, and the strict regulation of the contract fraud, and the fifth part is the self. Some suggestions on how to improve the sharing of car rental system are put forward.
