大学生兼职及实习期间劳动权益保护现状的实证研究
内容摘要
人才培养政策不断完善，高等院校录取人数逐年上涨，使得大学生人数逐步增长，大学毕业人数逐年增加。据教育部统计，到2020年，大学毕业生的规模有望达到874万。随着毕业生人数的不断增长，大学生将在就业方面遇到各种障碍。在社会就业压力的压力下，许多大学生会提前走进社会，积极参与社会实践活动，以提升他们的能力。但是，由于大学生刚进入社会，加上自身对劳动法及其劳动权益的了解相对较弱，使这一群体的利益容易受到侵犯；另一方面，中国的经济发展缓慢，许多公司为降低劳动成本，以低薪资招收实习生，这使得大学生兼职实习的劳动权益被侵犯的现象日益突出，因此，我们应更加重视对大学生兼职实习劳动权益的保护。
本文采用文献综述的方法，了解国外对大学生兼职实习劳动权益的保护现状。通过问卷调查法和文献综述的方法，了解和分析了大学生兼职实习的保护现状及保护力度。通过问卷调查分析的结果为维护大学生兼职实习权益等问题提出相应对策。

Abstract
Talenttrainingpolicieshavebeencontinuouslyimproved,andthenumberofcollegeadmissionshasincreasedyearbyyear,resultinginagradualincreaseinthenumberofcollegestudentsandanincreaseinthenumberofuniversitygraduates.AccordingtostatisticsfromtheMinistryofEducation,thesizeofuniversitygraduatesisexpectedtoreach8.74millionby2020.Asthenumberofgraduatescontinuestogrow,collegestudentswillencountervariousobstaclesinemployment.Underthepressureofsocialemploymentpressure,manycollegestudentswillenterthesocietyinadvanceandactivelyparticipateinsocialpracticeactivitiestoenhancetheirabilities.However,becausecollegestudentshavejustenteredthesociety,andtheirownrelativelyweakunderstandingoflaborlawandlaborrightsandinterests,thisgroupofpeople’sinterestsareeasilyviolated;Enrollinginternsatalowsalaryhasmadethephenomenonofinfringementoflaborrightsandinterestsofcollegestudentspart-timeinternshipsincreasinglyprominent.Therefore,weshouldpaymoreattentiontotheprotectionoflaborrightsandinterestsofcollegestudents’part-timeinternships.
