论我国网络购物合同的不足与完善

摘要:随着网络的不断发展，网络购物逐渐成为人民生活中不可划缺的一部分。网络购物在给人民带来便利和比实体购物的方便时也产生了不少的问题，尤其是在每年的315国际消费者维权日，网络购物中产生的质量问题，售后问题越来越多，网络购物的投诉已经连续成为近几年投诉的榜首。

而网络购物的兴起和方便性也造成了很多人忽视了网络购物的合同，在网络购物时，买方将商品放入购物车的行为，便视为买卖双方对于价款和标的物初步形成合意，购物网站随后会提示买方及时付款，故买方将商品放至购物车的行为应视为买方的承诺，买卖合同成立。而当买方将货款汇至支付平台，买卖合同即生效。

中国的网络购物是近年才兴起，尤其是在现代通讯网络发展的越来越多各种不一样的网络交易方法，但对出现交易纠纷或者事故后仍然没有更完善的法律去保障消费者或商家，从而每年因电子购物而产生的纠纷逐渐增多。为了应对未来和现代的电子商务，我国应该尽快完善电子商务法。
