小产权房买卖法律问题研究

摘要：小产权房买卖法律问题极其复杂尖锐，涉及民生、社会治理等多方利益，为了有效地解决小产权房问题，笔者对小产权房买卖法律问题进行研究、论述。本论文主要运用文献研究法与比较分析法对小产权房买卖法律问题进行研究分析。为了让读者对此论文课题有初步的印象，首先论述的是小产权房买卖的相关概述及买卖现象出现的原因，以便笔者逐渐深入讨论；紧接着笔者开始讨论小产权房买卖的合理性与法律上的可行性，得出小产权房买卖是能够符合社会发展潮流的且不违反法律规定的观点；再接着是结合社会现状，从立法、司法、执法方面提出小产权房买卖的法律困境，为完善小产权房买卖奠定基础；最后笔者根据所提出的法律困境给出了有针对性的解决措施，以期许未来能实现处理小产权房买卖法律问题无障碍、无争议。

Abstract：Thelegalissueofthesaleofsmallpropertyhousesisextremelycomplexandsharp,involvingthepeopleslivelihood,socialgovernanceandotherinterests.Inordertoeffectivelysolvetheproblemofsmallpropertyhouses,theauthorstudiesanddiscussesthelegalissueofthesaleofsmallpropertyhouses.Thispaperusesliteratureresearchandcomparativeanalysis.Firstofall,itdiscussestherelatedoverviewofthesmallpropertyrighthousesaleandthereasonsforthephenomenonofthesale,whichmakesthereadershaveapreliminaryimpressiononthesubjectofthispaper,sothattheauthorcangraduallydiscussitindepth;Thentheauthorbegantodiscusstherationalityandlegalfeasibilityofthesmallpropertyrighthousesales,concludedthatthesmallpropertyrighthousesalescanconformtothetrendofsocialdevelopmentanddoesnotviolatethelegalprovisionsofthepointofview;afterwards,itistolaythefoundationfortheimprovementofthesmallpropertyrighthousingsales.Accordingtothesocialsituation,itputsforwardthelegaldilemmaofthesmallpropertyrighthousingsalesfromtheaspectsoflegislation,justiceandlawenforcement;Finally,accordingtotheproposedlegaldilemma,theauthorgivestargetedsolutions,hopingtoachievethegoalofdealingwiththelegalproblemsofsmallpropertyhousesaleswithoutobstaclesanddisputesinthefuture.
