Enterprisesmusthaveacompletesetofregulationstoprotecttherightsofemployees.Thoseregulationsshouldincludestaffcontractmanagementterms,salarymanagementterms,socialsecurityandwelfareterms,workinghoursandleaveregulations,penaltyandbonusregulations,andothermanagementregulations.

Enterpriseshavetorecruitandemploystaffwithoutanyracial,nationality,genderorreligiousdiscrimination.

Enterpriseshavetosigncontractswithemployeeswithin30daysoftheirjoiningdate.Thecontractsshouldincludeclausescovering:workinghours,jobdescription,workprotectionandworkconditions,payment,discipline,terminationtermsofthecontract,obligationterms(ifthereisviolationofthecontract)andotheragreementsbetweentheemployeeandemployer.

Enterprisesmustsigncontractswithtemporaryworkersandofferthemsocialinsuranceaccordingtothelaw.

Employershavetofollowthepolicyofequalpaymentforequalpositions.

Salaryshouldbepaidincurrencywithoutunauthoriseddeductionordelay.

Salarycan’tbelowerthantheminimumlocalsalary(Chengdu:RMB270,Leshan,RMB213,Mianyang,RMB250).Ifthepaymentislowerthantheminimumlocalsalary,employershavetocompensatethedifferenceplusanadditionalfineof25%ofthedifference.

Enterprisesmustenforcethenewworkinghourscalculationpolicy(i.e.8hoursperday/40hoursperweek/20.92averageworkingdays(or167.4workinghours)permonthannuallycalculated.

Enterpriseshavetopasstheannualcheckbythelabouradministrationdepartmentandmustnotillegallyincreaseworkinghours.

Paymentofaminimumof150%oforiginalsalarymustbepaidforovertimework.
