ABSTRACT

Asteadystreamofaccomplishmentsinlegalacademicdevelopmenthasemergedasthe

systemofsocialistruleoflawwithChinesecharacteristicshasprogressed.Thefirstexhaustive

examinationoflegalactsinChinafollowingtheadoptionoftheCivilCodeofthePeople’s

RepublicofChinaisFalvXingweiLunwrittenbyYangDaixiong.Thebookisbasedonthe

basicprinciplesofcivillaw,combiningtherulesoflegalactsofChina’sCivilCodewithjudicial

precedents,drawingonnormsanddoctrinesincomparativelaw,andconductingin-depth

investigationandresearchonthefundamentalissuesoflegalacts.Ithasmadesignificant

theoreticalbreakthroughsinmanyareas.ThetranslationreportisbasedonChapterSeven,

SectionFourofthebook—Agency,whichcontains18,137Chinesecharactersintotal.

ChinesecivillawhasbeensignificantlyimpactedbyGermancivillaw,whichexhibitsits

distinctivestyleandcharacterwithitslegalactsservingasthefoundationalframework.

Regardingthelegalsystem,theUSandtheUKarepartsofthecommonlaw,whileGermany

andChinaarepartsofthecivillaw.Thetwolegalsystemsdiffernotonlyinlanguagebutalso

intermsoftheinstitutionsandprinciples.Asignificantnumberoftheconceptsoflegalacts

thatarediscussedinFalvXingweiLunderivefromGermancivillaw.Therefore,translatingthe

legaltermsinthesourcetextinvolvesnotonlylinguisticconversionbutalsoacomparisonof

thelegalconceptsbetweenChinaandGermany,aswellastheconnotativedifferenceoflegal

conceptsundertwodifferentlegalsystems.Thus,effectivelyhandlingthetranslationofsuch

legalterminologiesposesasignificantchallengeandisthefocusofthistranslationreport.
