法庭口译职业道德规范和行为守则

摘要：法庭口译是不通晓法庭语言的诉讼当事人在审判中获得司法公正的必要手段。法庭口译职业道德规范是该行业质量的保证。该文介绍了不同国家背景下（美国、西班牙、英国、澳大利亚和加拿大）的法庭口译道德规范和口译员行为守则中关于忠实性的规定，并从译员角色的角度分析了忠实性的含义和具体要求。该文探讨了道德规范所要求的忠实性与专业实践的复杂性之间的矛盾，揭示了法庭口译员所面临的职业困境，并提出了口译员保障忠实性的具体建议：法庭口译员须保留源语信息的所有语素，同时，了解诉讼程序和术语。道德规范不建议口译员机械地翻译，忠实的翻译不应与逐字翻译相混淆。口译员须根据其专业经验灵活执行忠实性原则。

Abstract：Courtinterpretingisanessentialtoolforlitigantswhodonotunderstandthelanguageofthecourtroomtoaccesstojusticeattrial.Thecodeofethicsforcourtinterpretersisaguaranteeofthequalityoftheprofession.Thisarticleintroducestheprovisionsonfidelityinthecodesofethicsforcourtinterpretersandguidelinesforprofessionalconductforinterpretersindifferentnationalcontexts（theUnitedStates，theUnitedKingdom，Australia，SpainandCanada），andanalyzesthemeaningandspecificrequirementsoffidelityfromtheperspectiveoftheinterpretersrole.Thepaperexploresthecontradictionbetweenthefidelityrequiredbythecodesofethicsandthecomplexityofprofessionalpractice，revealstheprofessionaldilemmafacedbycourtinterpreters，andproposesspecificrecommendationsforinterpreterstosafeguardfidelity：courtinterpretersarerequiredtoretainallthemorphemesoftheinformationinthesourcelanguageandtounderstandtheterminologyandtheproceedings;thecodeofethicsdoesnotrecommendthatinterpreterstranslatemechanically，sofaithfultranslationshouldnotbeconfusedwithverbatimtranslation;interpreterscanflexiblyimplementthefidelityprincipleaccordingtotheirprofessionalexperience.
