本2026年中英文保密及数据安全协议（以下简称“本协议”）由以下双方（以下统称“双方”）于____年____月____日（以下简称“生效日”）在____（签署地）自愿签署。为规范双方在合作及业务往来过程中保密信息的管理与数据安全保护事宜，明确双方权利义务，防范保密信息泄露与数据安全风险，保障双方合法权益，依据《中华人民共和国民法典》《中华人民共和国网络安全法》《中华人民共和国数据安全法》《中华人民共和国个人信息保护法》《中华人民共和国反不正当竞争法》及其他相关法律法规，结合双方合作实际情况，经友好协商，达成如下协议，以资共同信守。

This2026ConfidentialityandDataSecurityAgreement(hereinafterreferredtoastheAgreement)isvoluntarilysignedbythefollowingtwoparties(hereinaftercollectivelyreferredtoastheParties)on____(EffectiveDate)at____(PlaceofSigning).ForthepurposeofregulatingthemanagementofconfidentialinformationandtheprotectionofdatasecurityintheprocessofcooperationandbusinesstransactionsbetweenthetwoParties,clarifyingtherightsandobligationsofbothParties,preventingtheleakageofconfidentialinformationanddatasecurityrisks,andsafeguardingthelegitimaterightsandinterestsofbothParties,inaccordancewiththeCivilCodeofthePeoplesRepublicofChina,theCybersecurityLawofthePeoplesRepublicofChina,theDataSecurityLawofthePeoplesRepublicofChina,thePersonalInformationProtectionLawofthePeoplesRepublicofChina,theAnti-UnfairCompetitionLawofthePeoplesRepublicofChinaandotherrelevantlawsandregulations,andcombinedwiththeactualsituationofcooperationbetweenthetwoParties,thefollowingagreementisreachedthroughfriendlynegotiationformutualabidance.
