摘 要 基于当前的政策环境,版权合作是境外期刊进入我国传媒市场的主要途径, 也是境内外期刊涉及内容方面合作的唯一合法方式。受政策的严格限制,我国 期刊业从 1988 年开展版权合作至今,经新闻出版总署审核批准的合作项目仅 63 项。然而,我国期刊市场上实际公开出版发行的版权合作期刊数量远远超过了 新闻出版总署所公布的数目,这是因为有许多境内外期刊通过“灰色操作”实 现合作潜行在政策法规的边缘。 针对此现象,从期刊版权合作现有的政策规制可以看出,一方面,新闻主 管部门通过严格的政策规制手段对境内外期刊版权合作进行干预和限制;但另 一方面,市场实际运作却有悖于政策的要求。本文正是从“期刊版权合作的市 场运作与政策规制不接榫”这一现实问题入手,通过分析当前政策环境下期刊 版权合作的市场运作,探讨矛盾现象出现的原因,从而站在研究者的角度对期 刊版权合作政策规制的调整和完善提出一些创新思路,为我国当前在不断探索 中的传媒政策规制提供实践参考。 关键词:版权合作 市场运作 政策规制 创新 Abstract Based on current policy environment ,copyright cooperation is not only the main channel for magazines overseas to enter into Chinas media market,but also the only legal way of cooperation with local magazines concerning the contents. Due to the restrictive policy, only 63 collaborative projects have been licensed by GAPP (General Administration of Press and Publication of the Peoples Republic of China) since 1988. However, there are more than GAPP announced in the market because some collaborative projects are sneaking in the edge of policies and regulations without GAPPs approval by means of various grey methods. According to this phenomenon, it can be concluded from the existing policy that though the policy for magazines copyright cooperation is established to restrict and regulate the market operation, the fact came out against the purposes of regulation. Therefore, the article starts from this practical problem and tries to research into the reasons for the mismatching of the market operation with the policy regulation. Based on the study of the operation models both legal and grey, the article finds out the problems of current policy regulation and puts forward some innovative suggestion in order to provide some basic principles for the practice of China’s media policy which is still in the way to effectiveness and optimization.
