中文摘要 金融期货是近代金融市场产生的一种衍生工具。金融期货产生于二十世纪七十年代的 美国。三十多年来，无论是在发达国家，还是在发展中国家，金融期货都快速发展。与商 品期货相比，它具有更高的风险性。在现代市场经济条件下，金融期货的独有特点使得其 市场法律监管尤为必要。加强对金融期货市场的法律监管越来越受到各国政府的重视。 在我国，金融期货作为一种新生事物，科学的设计和实施相应的法律监管，可以使其 更好发挥套期保值功能、保护金融期货投资者的合法利益和维护金融期货市场的安全与稳 定运转。因此，有必要深入研究金融期货市场法律监管的相关理论。 本文共分三大部分。首先介绍了金融期货和金融期货市场监管的一般理论和以及我国 金融期货市场发展与监管现状，分析了我国金融期货市场现有监管制度存在的问题。其次 通过对美国、英国、日本、香港等发达金融期货交易市场的法律监管制度进行比较研究， 总结成熟、先进的市场法律监管经验及对我国金融期货市场法律监管制度的启示。最后分 别从完善政府监管、行业自律监管、交易所自律监管以及制定期货基本法及配套条例等方 面提出了完善我国金融期货市场法律监管制度的建议。 关键词：金融期货；金融期货市场； 法律监管； 完善 I Abstract Financial futures is a modern derivative of financial market. It originated from American in 1970’s. About thirty years, it developed speedily in developed countries and developing countries. Compared with commodity futures, it has a much higher risk. In the modern market economy, it is particularly necessary to regulate the financial futures legally. Governments began to attach importance ever-increasing to strengthen the legal supervision of Financial Futures market. Since the exchange of Financial futures is a new business in China, so scientific design and implement of the legal supervision will be crucial for safeguarding the rights and interests of the investors effectively and advancing it develop steadily. Then we should investigate the theory of the legal supervision of Financial Futures market. This thesis includes three parts: Firstly this part introduces the general theory of financial futures and financial futures market supervision, and then demonstrates the status and development of the financial futures market and the regulatory system in China.
