内容摘要 地理标志与商标一样，都作为一项独立的知识产权类型，以何种模式对地理标志进行 保护，是有关地理标志保护的学术研究与各国立法方面所关注的重点问题。本文从对地理 标志与相关概念的辩析、地理标志的法律特征、地理标志权的权利属性入手，并通过地理 标志的联系与区别的分析，深入探讨地理标志的法律属性；在分析保护地理标志的理论依 据的前提下，对地理标志各种保护模式进行介绍并分析其优缺点；通过对立法、行政管理 两方面的现实状况的分析，找出我国地理标志双重法律保护模式与“双轨制”行政管理体 系存在的问题，并就规范、统一地理标志用语、正确处理地理标志与地名商标的关系、制 定专门地理标志法等方面对完善我国地理标志保护体制提出建议。 关键词：地理标志；法律属性；保护模式 I Abstract Geographical indication, like trademark, is an independent type of intellectual property. What is the best mode to protect geographical indication, is very important when researching and lawmaking art taken on this subject. Firstly, via differantiating and analysing geographical indication and the relative concepts, legal charateristic, the attribute of geographical indicatiion right, and the relation and difference between geographical indication and trademark, this text takes further research on the legal attribute of geographical indication. Secondly ,before introducing different protecting mode of geographical indication and analysing the merit and defect of it , this text analyse the academic reasons of protecting it. Finally, by analysing the presentlegislative and administrative state, this textfinds theproblem existing inthe double legal protecting mode of geographical indication and adminitrative system, and give suggestion on perfecting the system of geographical indication protecting from the following aspects: regulating and consolidating the words about geographical indication, dealing the relation between geographical indication properly, and establishing special law on geographical indication.
