中文摘要 域名是一种互联网络技术普遍应用带来的新兴事物。对于域名及其权利性质的认识还 很不够。关于域名权有很多的争论，但大多集中在其和商标权的冲突上。笔者认为问题的 核心并不在于此，而在于如何看待域名这一新兴权利的性质——到底属于知识产权还是一 种普通的民事权利。本文采用了一套新的思路，拟从域名权的性质入手，试图找到其和传 统知识产权的联系和区别，以此分析现实生活中出现的诸如域名抢注、反向侵夺等和商标 权的冲突，最后对各国现有的域名保护体系进行分析，充分考虑对域名权保护的可能性及 最终制度的设计——一种区分的保护原则。 关键词：域名权；法律性质 ；利益衡平 I Abstract AAbbssttrraacctt Internet domain name is a universal application of the technology emerging things.
