大陆侨务立法及其对华侨华人投资影响研究——对比台湾地区引进侨资立法 大陆侨务立法及其对华侨华人投资影响研究 ——对比台湾地区引进侨资立法 摘 要：目前，吸引华侨华人回国投资，除了需要本国存在巨大的商机 外，还需要具备一个优良的投资环境。法律环境为一个国家的投资环境提 供了可靠的制度保障，是整个投资环境的重要组成部分。完善的侨务立法， 可以提供优良的投资环境从而吸引更多的侨资。因此侨务立法对侨商投资， 对中国的现代化建设意义重大。基于以上考虑，海峡两岸均把侨务立法视 为对外政策的重点组成部分。本文结合国内的华侨华人投资以及吸纳侨汇 侨资现状，分析大陆的侨务立法和涉侨法律法规所带来的利弊得失，并与 台湾当局的侨务政策制定与侨情现状进行对比分析。其研究目的在于提出 党的侨务工作，特别是侨务立法应该注意的问题和努力方向，为党和政府 在侨务方面的决策提供有益的参考。 关键词：侨务；立法；侨资 I 大陆侨务立法及其对华侨华人投资影响研究——对比台湾地区引进侨资立法 Abstract: In addition to more and more business opportunities, a good investment environment is also needed to attract oversea Chinese capital. While legal environment as the most important element of the investment environment, provides a reliable protective system to it. Therefore, a consummate legislation can provide a favorable investment environment to attract more oversea Chinese capital, and is of great significance to the modernization of China. Under this circumstance, both sides across the Taiwan Strait take the legislation on the oversea Chinese affairs as a key part of the foreign policy. The thesis is trying to analyze the advantages and disadvantages brought by mainland’s laws and regulations that are related to overseas Chinese, by taking into consideration the overseas Chinese investment and remittances in mainland. It is also trying to make a contrast between policy-making and the current situation of oversea Chinese investment in Taiwan and that in mainland. It aims to bring up the problems and directions that our Party should pay attention to when dealing with oversea Chinese affairs especially the legislation concerning them; to provide a useful reference to the decisions our Party and Government will make on the oversea Chinese affairs.
