内 容 摘 要 本文对刘栓霞由于长期遭受丈夫的家庭暴力最后愤而杀夫一案作了简要介 绍，并对与此案相关的“受虐妇女综合症”及正当防卫的构成要件进行了深入分 析，认为刘栓霞符合“受虐妇女综合症”的典型特征，得出了刘栓霞在“受虐妇 女综合症”的影响下故意杀人的行为是正当防卫的结论。 本文共约2 万5 千字，分为五个部分： 第一部分为案情简介。此部分对刘栓霞杀夫案作了简要介绍； 第二部分为争议焦点。此部分对刘栓霞案的定性争议作了详细介绍和分析， 并提出争议背后五个层面的问题，即：“受虐妇女综合症”及其西方经验问题； 刘栓霞的行为与正当防卫制度的价值关系问题；张军水虐待行为是否属于正当防 卫中的“不法侵害”问题；刘栓霞的行为是否符合正当防卫的“时间条件”问题； 刘栓霞符合 “受虐妇女综合症”的特征是否影响对其“防卫意图”的认定；在受 虐妇女综合症的影响下，刘栓霞将其丈夫杀害的行为是否符合正当防卫的“限度 条件”； 第三部分为法理分析。此部分对刘栓霞案涉及的法理问题进行了详细阐述。 文章论述了“受虐妇女综合症”问题的诞生背景、特征及对待“受虐妇女综合症” 的西方经验，分析了正当防卫制度之价值、“不法侵害正在进行”和“防卫意图” “防卫限度”的判断问题； 第四部分为案件结论。此部分对案件进行了综合剖析并得出了案件结论； 第五部分为余论，此部分将此案延伸至对犯罪与刑罚的讨论。 关键词：受虐妇女综合症 暴力周期 后天无助感 正当防卫 1 Abstract This article makes a brief introduction to the case of „the murder case of Liu Shuanxia‟, who suffered domestic violence for a long time, and analyzes battered women syndrome and justifiable defense that have some collection with the case, then concluded that the behavior and mentality of Liu Shuanxia corresponded with the feature of “batter women syndrome”, and killing Zhang Junshui was justifiable defense under the influence of “batter women syndrome”.
