摘  要  暴力作为刑法中一个重要的行为类型，是各国刑法重点规制的对象。域外刑 法对暴力有相关的规定，我国刑法中也多处明文规定了暴力。但我国在立法上对 暴力没有明确界定，理论界也很少从刑法角度研究暴力，即便涉及刑法中暴力的 问题也仅停留在对个罪形态上暴力的分析，对暴力的共性问题研究得很少，司法 实践中在处理暴力犯罪时也很容易产生分歧，因此，全面准确理解和研究暴力具 有重要的理论意义和实践价值。事实上，暴力存在很多共性的问题，如暴力的含 义、特征、功能、类型等，本文运用比较分析的方法，借鉴域外刑法及相关理论 的合理之处，结合我国的刑事立法和司法实践，从刑法解释学的角度对暴力的共 性问题进行了全面分析。首先，从分析域外刑法中暴力的含义入手，借鉴域外刑 法关于暴力含义的合理之处，评析我国对暴力含义的理论争议，界定我国刑法中 暴力的含义，从而进一步阐述了刑法中暴力的特征。其次，探讨了刑法中暴力的 功能与类型，并从不同的角度对刑法中的暴力进行了学理归类。再次，为准确理 解和认定暴力，对刑法中的暴力与相关概念进行了辨析，即对暴力与胁迫、伤害、 行凶、强制、恐吓等概念进行了辨析，结合我国刑事立法和司法实践，借鉴域外 刑法界定出这些相关概念的含义，并分析出暴力与这些概念的区别。最后，根据 刑法中暴力的这些共性问题，笔者从宏观上分析了我国刑法中暴力规定所存在的 立法缺陷，并提出了四点立法建议。对刑法中的暴力进行共性地、体系性的研究， 其目的在于为分析具体个罪的暴力行为提供一个共性的原则，为司法实践中认定 涉暴行为提供理论支持。 关键词：刑法；暴力；暴力犯罪；胁迫；伤害 I Abstract As an important behavior type in the criminal law, the violence is an object specified by various countries criminal laws. The violence has not only been enacted in the criminal law outside Chinas territory, but also has been prescribed in many articles of the criminal law of our country. Nevertheless the violence has not been cleared about its limits in legislation and the theory circle also study it little from an angle of penal law in our country, even involving it, the analysis of the violence is only limited to the individual crime and involves much few general problems about violence .In judicial practice some differences exist easily when processing violent crime. Therefore, the comprehensive accurate understanding and the studying violence have the important theoretical significance and the practical value. In fact, there are many common problems in violence, such as the meaning, the characteristics, the function and the type.
