摘 要  行政法的精髓在于裁量  扩大自由裁量权是现代依法行政的要求 加强对行政自 由裁量权的控制更是依法行政的必然趋势 行政立法裁量权发生在行政立法领域中 原则上是行政机关的自由裁量权 为此 我们应该重视这种裁量权 以便采取有效的 制度手段予以控制 从而消除其对社会的危害性 行政立法必须受到严格的规范和控 制 否则会对法治国理论 民主原则构成极大威胁 本文通过考察 分析行政立法裁量权的含义 对行政立法裁量权进行界定 并探 讨行政立法裁量权表现样态 较为全面的剖析行政立法裁量权 接着 本文介绍了我 国行政立法裁量权存在的法律依据以及在实践中的问题 并从权利保障 行政法治 督促履行立法义务和节约立法资源等方面指出行政立法裁量权滥用将导致的危害性 证明对其进行控制的必要性 文章的中心在于着重地探讨了如何完善对行政立法裁量 权控制 从而对现今社会上大量存在的行政立法裁量权以规范 引导和控制 在提出 对行政立法裁量权的立法控制时 主要从授权明确性原则及明确立法期限 撤销立法 授权及通知立法三个事前事后机制来论述 在提出对行政立法裁量权的程序性控制时 着重从行政立法的提议 听证制度 信息公开制度以及说明理由制度等方面来建构对 行政立法裁量权的程序控制的机制 最后 本文在介绍了对行政立法裁量权司法控制 的必要性和欧美司法审查的相关做法之后 尝试在我国的法制基础上建构对行政立法 裁量权的司法控制 并提出对我国司法审查的展望  关键词:行政立法 裁量权  立法  程序  司法审查  I Abstract The expanding of Discretion Power is the request of modern legal administration, it’s inevitable trend of modern legal administration to strengthen controlling. The administrative legislation Discretionary Power occurs in the administrative legislation domain, in principle is administrative organs freedom. Therefore, we should take this kind of Discretionary Power seriously, in order to adopt the effective system method to control. The administrative legislation must receive the strict standard and the control, otherwise it can be the enormous threat to the legal theory of rule of law and the principle of democracy. This article through the inspection and the analysis of the meaning of the Discretionary Power of administration legislation, the performance and the basis of existence of the Discretionary Power of administration legislation, to make more comprehensive analysis on the Discretionary Power of administration legislation; Then, Considering the aspect of the right safeguard, the administration by law, supervise the fulfills of the legislation duty and saves legislation resources, it is necessary to carry on the control of the Discretionary Power of administrative legislation.
