试论经济法的社会整体利益观-毕业论文.doc

华 中 科 技 大 学 硕 士 学 位 论 文  摘  要  社会整体利益观在经济法基础理论体系中处于十分重要的地位，近年来关于这 一理论的研究逐渐深化，但存在诸多问题，比如概念表述不一，学者观念分歧较大， 基础理论研究和具体部门法研究相脱节等等。本论文试图从社会整体利益概念分析 着手，结合中国传统法律思想中的整体观对我国经济法发展的启示，探讨经济法独 特的社会整体利益观，并以反不正当竞争法为例说明社会整体利益观在经济法次部 门法中的表现。 全文主要分为四个部分，第一章内容主要是社会整体利益概述。该部分通过社 会整体利益与社会利益、国家利益、社会公共利益这些概念的比较对其进行概念解 析，并阐述社会整体利益观在经济法理论体系中的地位。 第二章主要探讨儒家法律思想中的整体观对认识经济法社会整体利益观的意 义，并从其具体表现中进一步分析其对经济法发展的启示。 第三章是本文的核心部分，主要论述社会整体利益的经济法之维。这一章又分 为三个小节，第一节分析经济法社会整体利益观的独特性；第二节阐述经济法社会 整体利益观所体现的核心价值——实质公平；第三小节进一步探讨经济法对于社会 整体利益的维护和保障。 最后一章则以探讨我国反不正当竞争法的修改入手分析经济法社会整体利益观 在其次部门法中的表现，并对我国现行反不正当竞争法的修改提出几点建议。 关键词：社会整体利益观 经济法 整体观 反不正当竞争法 I 华 中 科 技 大 学 硕 士 学 位 论 文 Abstract The view of social integrated interest occupies a very important position in the theory system of economic law, the research of which become deeper gradually in recent years. On the other hand, the research on this theory exist several problems, such as inconsistence in the explanation of concepts, some difference in some idea and the separation in research between the basic theory and the specific branch law. With the beginning of a brief account of the social integrated interest, this paper tries to probe the special view of social integrated interest in economic law, combining with the enlightenment to the development of economic law from the whole view of Chinese ancient traditional law idea. At last, this paper illustrates the expression of the view of social integrated interest in the branch law of economic law with the example of law of counter-unfair competition. The whole text can be divided into four chapters. The content of the first chapter is the brief account of social integrated interest, which is analyzed through being compared with other concepts, including social interest, national interest and social public interest. It also explains the position of the view of social integrated interest in the theory system of economic law.
