Root和刷机行为的法律评析 ——以“越狱条款”为视角 摘要 中国在加入WCT，WPPT之后，便根据这两项条约的要求，引入了对技术措施的保护。但目前国内外厂商借技术措施行限制竞争之实的行为已经屡见不鲜。 本文从对2010年美国版权法颁布的规避访问控制技术措施新例外中的第二条“越狱条款”的讨论中，分析这一本针对苹果手机的“越狱条款”对Android手机中访问控制技术措施规避行为的影响，以及对我国的立法和法律解释的启示。本文主要采用比较法的角度，对美国技术措施和我国技术措施保护的规定进行对比分析，对新形势下的新规避技术措施行为分三部分进行讨论。 第一部分，首先简要介绍，目前手机产业中存在的技术措施种类，这是能够进行下文讨论的技术前提。其次分析这些技术措施对消费者带来的不利影响。 第二部分，简要介绍美国技术措施立法的背景，从“越狱条款”入手，进而分析在美国法背景下“越狱条款”对Android手机的访问控制技术措施规避行为的影响，并从中得出美国版权法对技术措施法律保护存在的不足。 第二部分，系统介绍中国版权法立法中对技术措施保护的体系，从而讨论目前的主要规避技术措施的行为，进行我国版权法视野下的分析。从而得出一些建议与意见。 [关键词] 技术措施 反规避技术措施 数字版权法新例外 Analysis of the affection of jailbreak provision to the android smartphone industry Abstract With the rapid development of the smartphone industry, some manufacturers start using technological measures to protect their operation system .However ,it also confine the smartphone user using the smartphone .Sometimes ,they are willing to circumvent the technological measures .There are some legal problems behind this phenomenon. This paper consists of three parts. Part one briefly introduces the main technological measures of the smartphone industry and the adverse affection. Part two, at first, briefly introduce the background of the Digital Millennium Copyright Act. Then According to discussing the section 2 of New Exemptions, it would analyze the affection of the provision to the Android smartphone industry. At last, it would conclude what is insufficient in American Anti-Circumvention of Technological Measures Law. Part three systematically introduce the Chinese Copyright Law on technological measures. On the basis of analysis of the nature of Circumvention act in Chinese law, it will get a conclusion that what is insufficient in Chinese Copyright Law on technological measures.
