海上货物运输保险利益主要问题的研究.doc

摘  要  海上货物运输保险是现代保险制度的起源，对海上货物运输保险利益的争论 巨大，而我国《海商法》对此却没有明确的规定，以至在海上货物运输保险利益 制度中，需要适用《保险法》的规定，造成了诸多理论和实务问题。 《海商法》关于保险利益适用《保险法》只是权益之计， 海商法》修改在即， 应当更多地将海上货物运输保险利益置于《海商法》的视野下进行研究，还海上 货物运输保险利益本来之面目，而非局限在《保险法》的视野内研究。 我们研究的海上货物运输保险利益，不仅仅包括狭义的海上航行阶段，也包 括路上货物运输和装运阶段，我们认为两者密切关联，不可分割。 全文写作围绕两个大问题展开，一个是海上货物运输保险利益的内容，另一 个是海上货物运输保险利益与风险负担的关系。全文具体内容安排如下。 第一章是对海上货物运输保险利益制度概述。我们研究了保险利益和海上货 物运输保险利益的定义，阐述了海上货物运输保险利益的特点和研究价值；同时 列举了各国法律对保险利益的规定，并对此进行了比较，形成了对保险利益较为 全面的认识。 第二章和第三章研究海上货物运输保险利益的内容。其中第二章属于基本内 容，属于海上货物运输保险制度保险利益基本内容的归纳。第三章属于特别规定， 主要研究海上货物托管人享有保险利益的情况，此种情况构成了对风险负担理论 的挑战，同时也丰富和补充了风险负担理论。 第四章研究海上货物运输保险利益归属判断与风险负担理论的关系。主要研 究国际贸易术语下和合同约定下保险利益归属与风险负担的关系，最后是对我国 海上货物运输保险利益制度的思考。 关键词：保险利益；海上货物运输保险利益；风险负担 I Abstract Marine cargo insurance is the origin of the modern insurance system，the debate on marine cargo insurance interests is huge and the China Maritime Law has not clearly defined，as well as in marine cargo insurance in the interests of the system.you need to apply the Insurance Law provisions，resulting in a theoretical and practical problems.
