摘 要 随着养殖业逐渐成为现阶段农村经济发展和农民增收的亮点，养殖业保险对 养殖业发展的保障作用也随之日益显现。养殖业保险发展的新变化，需要养殖业 保险法律制度研究，为其提供理论基础。对养殖业保险法律制度的系统理论研究， 不仅可以对养殖业保险的业务实践提供指导，更能够对养殖业保险的立法提供理 论指导。 养殖业保险的定义是指以各种处于养殖过程中的有生命的陆生动物或水生 生物为保险标的，保险人在被保险人支付约定的保险费后，对养殖过程中保险标 的因遭受保险责任范围内的自然灾害、意外事故和疾病所造成的损失，对被保险 人进行经济补偿的一种保险业务。它具有保险标的的特殊性、风险单位的相对较 小性和道德风险的特别严重性三大特征。在类型上可分为牲畜保险、家禽保险、 水产养殖保险、其它养殖保险四种类型。养殖业保险合同的订立，除了遵循自愿、 平等、公平、诚信等一般原则之外，还需遵循最大诚信原则、保险利益原则、损 失补偿原则等特殊原则。养殖业保险费率的厘定需考量国家或区域经济发展水 平、投保人保费承受能力、养殖业保险本身的风险和利润等因素。对养殖业保险 活动进行必要的监管，是保证养殖业保险正常运作并有效发挥养殖业保险功能的 必要措施。投保人、被保险人、保险人和保险中介人在养殖业保险活动中的一些违 约、骗保行为，以及国家机关及其工作人员不履行或不正确履行相关支持或监管职责 的，应当承担相应的法律责任。 关键词：养殖业保险；合同；费率；监管 Abstract With the development of culture industry , which becomes a new way to develop rural economy and increase income, animal husbandry insurance becomes more important than ever before to effectively guarantee the culture industrys success. The study on the legal system of animal husbandry insurance is extremely important to deal with the different situations or cases in the growing process of culture industry. The study is a guidelines of practices and legislation . As one kind of the insurance business, animal husbandry insurance should be scientifically defined. The object of insurance are the live terrestrial animals and aquatic animals during culture period. After paying for the appointed insurance premium, the insured should be compensated for the loss of the object of insurance caused by natural disasters,accidents or diseases under Insurance coverage.
