摘要 试论刑法对男性性权利的保护 摘 要 性权利是人最基本和重要的人身权利之一，不应因男女的性别而区 别对待。随着社会的快速发展、女性地位的不断提高、同性恋现象的逐 渐被认可，人们对于“性”的接受和认知度已经明显提高，然而现行法 律，尤其是作为最高刑罚规定的刑法，却对性权利、尤其是男性性权利 的保护存在严重的滞后和缺失。本文从完善我国对保护性权利的立法出 发，论述对男性性权利疏于保护的原因和加以保护的必要性，深入分析 社会实践中侵害男性性权利的各种行为，结合国际立法经验，提出对刑 法如何保护男性性权利的修改建议：第一，将女性纳入性犯罪的行为主 体，真正实现男女平等；第二，将性犯罪的对象扩大至“他人”，重视男 性也能成为性侵害的被害人这一社会现实；第三，明确强奸罪中性交的 形式；第四，对同性性行为予以立法规范。 关键词 男性性权利，同性性侵犯，刑法保护，强奸罪 III 上海交通大学法学硕士论文 THE RESEARCH ON THE PROTECTION FOR THE RIGHTS OF MAIL SEXUAL ABSTRACT Sexual rights is one of the basic human and personal rights, and should not be treated differently because of the male and female gender.
