摘  要  博客是一种新事物  在中国已经有超过 1750 万的人在使用博客  其影响力 不容小觑 但是许多人还不清楚博客是什么 本文从宪法学的角度出发 对博客 进行探讨 首先 介绍博客的发展历程 介绍什么是博客 从宪法的角度看 博 客就是集言论自由 新闻自由 出版自由于一体的表达自由 作为表达自由的新 方式 与传统媒介相比 它有广泛性 即时性 去中心化等特点 与 BBS 相比 它有理性化 功能强大 稳定性等特点 博客的这些特点给我们带来了挑战 这种挑战既有好的一方面 也有不利的 一方面 好的表现为 强化表达自由的经典宪政价值和使公民新闻出版自由有所 发展 而博客带来的严峻挑战则表现为 与隐私权 名誉权等其他权利相冲突 与国家秘密 社会利益等国家权力相博弈 我们国家该如何应对博客呢 我们应根据其带来的挑战作出对策 首先 重 视博客的宪政价值 应该以民主为总目标 以保障为主 限制为辅 法律明确规 定 限制具体为原则 其次 在民主这个大原则下区分不同情况应对博客 价值 协调 适用利益均衡原则 与权力博弈 适用比例原则 与现有法律相调适 不 能盲目立法 应该以现有法律为依托 再次 在具体的做法上 还可以借鉴如下 方法 鼓励 游说 鼓励行业自治 着重对几个大的博客网站(ICP)的监督与引 导等等 总之 博客的监督与引导 应该以民主为目标 做到对民主的承诺 谨慎行 事  关键词  博客  表达自由  去中心化  民主  I ABSTRACT The blog is a kind of new things. But in China, more than 17,500,000 people have already used blogs. We can’t look down upon their influence. But many people still don’t comprehend clearly about what is blog. In this text, we will reflect on the Blog under the Constitution, and carry on a study to the blog. First, we will introduce the developing process of blog and the blog’s concert. In point of view Constitution, the blog is the expression freedom that including freedom of speech, freedom of press and freedom of publish. As a new way of expression freedom, compared it with the traditional medium, it has the following characters: universality, instantness and acentric. Compared with the BBS, it has the characters of reasonableness, strong function, stability etc. These characteristics of the blog determine its constitutional value as follows: increasing knowledge and studying from each other; participating in self-government and setting up a democratic government; developing individuality and creating multiplex society; forming a mechanism which inspects the of the power by society gradually.Obviously the blog has a lot of constitutional value, but at the same time it goes with risks. These risks including: infringing personal rights, resulting in abruption and isolation etc. So, what should we do? Concerning how to
