摘  要  本文从行政监督制度与权力结构动态平衡的视角来研究行政权控制，试图从 这个视角获得一些新的认识，使人们对行政权控制规律的理解更为全面和深入一 些。 本文共分 5 章：第 1 章在分析选题背景、意义，述评国内外行政权控制研究 成果的基础上，提出了本文的研究思路、方法、内容和可能的创新点。第 2 章在 界定相关概念和分析行政监督制度与权力结构的矛盾关系基础上，阐述了行政监 督制度与权力结构动态平衡的涵义，即指这样一种可能状态，在一定的政治、经 济、社会、文化条件下，权力结构与行政监督制度相互匹配，权力结构使作为一 种博弈规则的行政监督制度构成了一个纳什均衡，行政监督制度中的任何一方博 弈主体都没有积极性（或者说激励）去按制度以外的规则行事。接着探讨了该平 衡的主要特征。第 3 章阐述论证了该动态平衡的价值，即保持行政监督制度与权 力结构之间的动态平衡是有效控制行政权的关键。第 4 章分析了该动态平衡的主 要影响因素，包括制度变迁的模式、行政监督制度的初始选择、科学技术发展的 水平、市场经济发育的程度、政治体制改革的深度。第 5 章提出了实现该动态平 衡的两条主要思路，一是调整行政监督制度以适应权力结构，二是优化权力结构 以支撑行政监督制度，并分别阐述了具体措施。 本文最主要的创新成果就是为研究行政权控制提供了一个新视角，即从行政 监督制度与权力结构动态平衡的视角来研究行政权控制，并对该平衡的涵义、特 征和价值进行了探索性的阐述论证。这不仅有利于推进行政监督理论研究，而且 对构建行政权力制约机制有着重要的现实意义。 关键词：权力；权力结构；行政权；行政监督制度；动态平衡 I Abstract The thesis explores on the control to administrative power from the perspective of the dynamic balance between administrative supervision regulations and power framework. It also tries to get some new knowledge from this perspective in order to let the people have an all-sided and deep understanding of the rules of control to administrative power. The thesis falls into five chapters. Chapter 1 puts forward the research clew, methodology, contents and possible creative points based on the analysis of the background, significance and literature review of the research topic. Chapter 2 illustrates the connotation of the dynamic balance with the definitions of correlative concepts and the analysis of the contradictory relationship between administrative supervision regulations and power framework. It is a possible status that power framework matches with the administrative supervision regulations under certain political, economic, social and cultural circumstances. Power framework makes the administrative supervision regulations, a Game Theory regulation, to form a Nash balance.
