摘 要 本文通过对 2011 年以前房屋拆迁过程中有关犯罪案例的研究，对造成这种状 况的社会原因和个体原因进行深刻剖析，从而提出防止房屋拆迁过程中犯罪继续发 生的相应措施，遏制房屋拆迁过程中出现的犯罪浪潮，实现和谐拆迁、阳光拆迁、 公正拆迁。具体而言，本文将分为四章来阐述房屋拆迁过程中发生的犯罪问题。 第一章将主要分析房屋拆迁过程中犯罪的现状。将 2011 年以前房屋拆迁过程 中发生的犯罪进行归类分析，以犯罪手段为依据分为暴力犯罪和职务犯罪，并以此 为线索展开房屋拆迁过程中暴力犯罪和职务犯罪的犯罪情况和犯罪危害的论述。 第二章将以第一章不同主体的分类依据为线索，从拆迁人、政府工作人员、被 拆迁人三个主体来具体阐述房屋拆迁过程中的犯罪现象及其犯罪特点。 第三章将从犯罪原因的角度探析房屋拆迁过程中的犯罪问题，犯罪原因总体上 可以分为社会原因和个体原因两个方面，对于社会原因将从立法的角度、司法的角 度和行政的角度三个方面来阐述，并且还将具体分析房屋拆迁过程中的拆迁人、政 府工作人员、被拆迁人犯罪的个体原因。 第四章将以2011年国务院颁布的新的《国有土地上房屋征收与补偿条例》为 契机，对房屋拆迁过程中犯罪的预防对策进行系统化分析，并从立法、司法、行政 三个方面着手分析预防房屋拆迁过程中犯罪发生的对策，从而遏制房屋拆迁过程中 犯罪的继续发生。 关键词：房屋拆迁；犯罪现象；犯罪原因；犯罪对策 I Abstract This article discusses the criminal casework of housing demolition happened before the year 2011, analyzes the social cause such as legislative, judicial and Executive, elaboration the criminal motivation of the subjects of crime, in order to advance a theory to intend to prevent crime. This text is divided into four chapters to parsing problem in the housing demolition. The first chapter mainly analyzed the dismantlement process crime situation. Will the 2011 before the house dismantlement occurred in the process to categorize analysis, crime based on crime means into violent crimes and the duty crime, and so on for clues dismantlement process violent crime and criminal duty crime and criminal damage described. The second chapter will use the first chapter of different subject as a clue, classify from the dismantler, government workers, the dismantles three main body to expounding the dismantlement process and characteristics of crime is a crime. The third chapter will analyze the crime causes Angle in the process of dismantlement readers.it
