产品缺陷 专业：法学 学 号：5301110130 姓名：李娟 指导老师：章亮明 摘要 产品责任法体系是以产品缺陷制度为中心而建立起来的，它是围绕产品是否存在缺陷来确定产品责任及责任分配的。一国的产品缺陷及其认定标准的法律制度体现了该国产品责任法的原则和价值目标，也是其法律制度发展水平的标志。我国产品缺陷的概念借鉴了美国《第二次侵权法重述》中的内容，将产品存在的不合理危险作为核心，具有浓厚的比较法色彩，但是在不合理危险的界定以及产品缺陷的认定标准等方面，两国的规定存在着较大的分歧，体现了两国平衡生产者、销售者和消费者利益关系的法律政策倾向。因此要完善我国产品责任立法，首先就要构建以产品缺陷理论为中心的产品责任制度，而这样的理论框架必须是以明确对产品缺陷认定标准研究的重要性和必要性为前提的。同时，要用理性的思维对待我国产品缺陷具体法律制度的立法改进和发展，在借鉴外国先进制度的基础上使其内化于我国具体国情尤为重要。 关键词：产品缺陷；产品缺陷类型；认定标准；完善 Product defects Abstract Product liability law system is established with the product flaw system as the center, it is based on whether the product defects to determine the product liability and responsibility distribution. Product defect legal system of a country and the judging standard embodies the principle and goal of value of product liability law of the country, but also a symbol of the development level of the legal system. Chinas concept of product defects from the American second restatement of tort law in the content, the unreasonable dangerous products such as the core, has a strong color of comparative law, but in the unreasonable risk definition and the standard of product defect and so on, the two provisions exist great differences, reflects the legal and policy tendency of producers, sellers and consumers of the balance of interests. Therefore, to improve the product liability legislation in our country, we should construct the system of product liability on the theory of product defect as the center, and such theoretical framework must be clear on the importance and necessity of product defect legal standard research premise. At the same time, to the improvement of legislation and development of Chinas treatment of product defects with rational thinking of the specific legal system, on the basis of the foreign advanced system makes it particularly important to the specific national conditions of Chinas internalization.
