Master Dissertation of Chongqing University The Comparative Study on Government Investment Project Bonding System Master’s Degree Candidate: Ou Hui Supervisor: Associate Prof. Yang Yu Major: Management Science Engineering Faculty of Construction Management Real Estate Chongqing University October 2007 摘 要 工程保证担保是国际上保障建设工程承发包合同履行的一种重要的信用工 具。由于政府投资项目中存在业主缺位问题，所以相较私人投资项目而言，其更 缺乏防范项目风险的内在机制和动力。工程保证担保在政府投资项目中的应用不 仅可以转移风险，保障公共投资的安全，而且也是减少腐败的一种有效措施。通 过立法对政府投资项目实行强制性工程保证担保正在成为一种国际潮流。我国政 府投资项目保证担保制度正处于试点推行的起步阶段，存在许多急待解决的问题 和需要完善之处。本文通过对当前国内外政府投资项目保证担保制度进行系统、 全面的比较研究，为完善和发展我国的政府投资项目保证担保制度提供了有益的 借鉴和参考。 本文应用理论研究方法阐述了担保以及保证担保的定义和关系组成，并运用 信息经济学原理分析了保证担保的运行机制和市场功能。运用对比研究的方法对 国内外政府投资项目保证担保制度的立法、保函类型、承保人、保额、担保品种 进行了全面、深入的分析。在对比分析的基础上，借鉴国外成功经验，并结合我 国的具体国情，提出了解决目前存在的问题、完善我国政府投资项目保证担保制 度的一些建议和措施。 关键词：工程保证担保，政府投资项目，比较研究 ABSTRACT Construction contract guarantee /bond is an important credit instrument to guarantee the performance of a construction contract. Since the absence of owners in government investment projects, the lack of inherent mechanism and power for preventing risks is worse than private investment projects. The application of contract bond in government investment projects can not only transfer risks to protect the public investment, but also can effectively reduce the corruption. Through legislation to applying mandatory contract bond in government investment projects is becoming an international trend.
