随着我国市场经济的发展和不断深化,国家对消费者权益的保护也越来越重视,不
仅以立法的形式将消费者的权利予以法定化,也在程序法上确立了消费者权益的实现途
径。我国《消费者权益保护法》规定了和解、调解、申诉、仲裁和诉讼五种消费纠纷的
解决途径。但是,随着社会的进步和消费者维权意识的增强,这五种纠纷解决方式在现
实运用中均或多或少的暴露出缺陷,其相互之间也缺乏有效衔接,这就大大影响了消费
纠纷解决机制整体效能的发挥。本文试从我国消费纠纷解决机制的现状入手,结合现实
中凸显的问题,研究借鉴国外一些成熟经验,探求矛盾的症结所在,继而对我国消费纠
纷解决机制的完善提出几点建议。

Abstract
As Chinas market economy development and deepening, the state protection of the
rights of consumers are more and more attention, not only in the form of legislation will be
statutory rights of consumers, but also procedural law establishes the realization of the
interests of consumers way. Chinas Consumer Protection Law stipulates that the
conciliation, mediation, appeals, arbitration and litigation settlement of consumer disputes are
five ways. However, with social progress and awareness of consumer rights protection, the
five dispute resolution used in the real world are more or less exposed flaws in its lack of an
effective link between each other, which greatly affected the consumption overall
effectiveness of the dispute resolution mechanism to play. This paper tries to resolve
consumer disputes, the mechanism of the status quo of the problems highlighted with the
reality, of a number of mature experience from abroad, and explore the crux of the conflict,
and then to Chinas improving consumer dispute resolution mechanism put forward several
proposals.
