摘要
农地产权制度是国家土地产权制度的重要组成部分，也是我国农村制度的基础与核心。现阶
段我国的农地产权表现为在一个主体不明的农民集体土地所有权之下，农户拥有农村土地承包经
营权的简易制度。本文从经济学和法学的角度对我国农村士地制度中士地产权的界定、归属及有
效保护进行研究、分析和诊断，探究制度设计的缺陷成因、制度变迁的制约因素和制度改良的努
力方向，对我国农地产权的改革与完善提出了建设性的建议，得出淡化农民集体土地所有权，赋
予农民享有“私有化”的农地使用权的结论，并就农地产权制度的权利体系、权利功能以及权利
保护诸方面作出设计，同时就相关制度提出改革的设想。
