摘 要 摘 要 现有的调整交易纠纷的法律规则，大都是建立在传统的有形交易模式之下的。随着 科技的发展和网络时代的进步，新的交易模式电子商务、在线交易等已经悄然走入了 我们的生活，影响着现实生活的方方面面。随着纠纷的不断涌现，在新的历史背景下 制定适应在线交易的法律规则，成为历史的必然。虽然在这个领域的探讨早已开始， 但是尚没有形成普遍被接受的在线交易规则，对其探讨仍然有很大的必要。笔者在广 泛学习的基础上，也对此问题进行了深刻地思考。本文主要内容是，研究了电子商务 发展的历史，以及世界不同国家对此问题的态度，把整个在线交易的过程做解析性的 分析，找出了其中存在的问题和产生原因，最后针对该问题的缺陷提出具体的针对性 建议。 本文对在线交易法律规则做出详实的研究，并提出完善的建议。对我国在线交易的 实践和相关法律的不断完善和发展起到了一定的研究和借鉴意义。 关键词 在线交易 法律规则 制度构建 I Abstract Abstract The current statutory rules which adjusting the transaction disputes, mostly are established under the traditional tangible trading pattern. Accompanied with development of the technology and advancement of the network era, new transaction patterns such as electronic commerce and online transaction has came into our life quietly and has affected all aspects in real life. It is historically inevitable for formulating statutory rules which adapts to the online transaction in the new historical context, accompanied with constant emergence of disputes. The research in this field has already started, but the online transaction rules that can be accepted universally are not yet formed, so, it is necessary to study on it. Based on a wide range of learning, the author has reflected on this issue in depth. This paper is mainly about study on history of development of electronic commerce and attitude of different countries on this issue, and it has analyzed the whole process of the online transaction analytically, and has found its existing issues and causes, finally, it has provided specific and pertinent suggestion on defect of this issue.
