法 律 硕 士 专 业 学 位 论 文 论我国探望权主体制度及其完善 On the Visitation Right Mian System and Its Perfection  作 者 姓 名： 指 导 教 师：  罗丽雅 陈 苇 教授  西 南 政 法 大 学 Southwest University of Political Science and Law 内容摘要 2001 年我国在修改《婚姻法》时，首次确立探望权制度。该项制度的设立填补了我 国立法的空白，完善了我国婚姻家庭制度，既有利于维护离婚父母双方的合法权利，也 有助于引导未成年子女身心健康发展。但由于立法指导思想和立法环境的局限，我国婚 姻法规定探望权主体仅限于离婚后不与未成年共同生活的父或母一方，此项规定过于狭 隘且悖离了探望权的立法本质，导致司法实践中产生诸多矛盾与困惑。 本文从实例出发，联系理论与司法实践，对比域外有关探望权主体制度的立法，剖 析我国探望权主体制度存在的不足，从立法和司法的角度对探望权主体制度提出一些构 想。 本文除引言和结语之外，分为五个部分，共约 1.6 万字。 第一部分典型案例。本部分包括详细的案情、一审和二审法院的审理情况、案件的 主要争论焦点。 第二部分探望权制度之考察与解读。该部分主要包括三节，第一节和第二节分别介 绍探望权的功能和探望权的性质。第三节探望权主体制度的主要内容。该节阐述了探望 权的主体范围、探望权主体的权利义务，以及对探望权主体的审视。 第三部分探望权主体制度域外立法之介绍与评析。该部分主要介绍了大陆法系国家 和英美法系国家有关探望权主体制度的立法现状，并就大陆法系国家和英美法系国家探 望权主体制度相关立法进行比较和评析。 第四部分我国探望权主体制度之不足。一是介绍了我国现行立法现状，二是分析我 国探望权主体制度存在的不足与缺陷，包括未规定“儿童最大利益”原则、探望权的权 利主体范围过于狭窄、探望权的义务主体范围过于狭窄。 第五部分完善我国探望权主体制度之建议。针对目前我国立法和司法实践现状，提 出确立“子女最大利益原则”，拓宽我国探望权权利主体和探望权义务主体范围的立法 建议。 关键词：离婚；父女；子女；探望权；主体范围；立法建议 1 Abstract China in the 2001 amendment to the Marriage Law, for the first time establish the a visit right system.
