摘要 摘 要 经济全球化已是当今时代的发展潮流与客观趋势，大部分国家的政治、经 济、文化格局都被这种潮流影响着。在金融体系中，外资银行的地位和影响日 益突出，而外资银行的发展历来都是一把双刃剑，它很大程度上推动了世界经 济的高速发展，同时却也使得经济发展更加具有风险性。随着外资银行的业务 全能化，范围国际化，资金信贷量的几何倍数增长，其在国际金融市场上的作 用也愈加重要。正因为如此，繁荣的外资市场背后隐藏的巨大金融风险也决定 了该行业必然会有一段泡沫非常时期，而2008年的那场看似突如其来实则必然 的金融危机也就很好的说明了这一点。在这种情况下，人们不得不转换思维去 拯救这个行业，于是如何更好的对外资银行进行监管，建立更好的监管法律制 度这个重要议题就引起了国际社会的强烈关注。 本文旨从外资银行法律监管基础理论展开论述，对当前国际社会外资银行 监管领域最重要的指导文件《巴塞尔协议III》进行介绍、评价，进而指出我 国外资银行监管的法律现状，并将我国所出台的对策与《巴塞尔协议III》进 行比较，从整体上找出我国相关制度上的不足之处，并同时结合其他国际上对 外资银行监管的有效经验以及我国基本国情对我国日后的制度改革、完善工作 提出自己的见解。 关键词：外资银行；巴塞尔协议III；监管合作 I Abstract ABSTRACT The Economic globalization is the objective trend in this world , most of the countryspolitic, economyandcultureareaffectedinit.Inthe financial system,the role of foreignbanks is more and more important. The effect of foreignbanks has two sides,itpromotetherapid development ofworld economy,atthe sametime is alsomaketheeconomicdevelopmentmuchmorerisky.Thefactprovethatwiththe increase ofnumber of foreign banks, its role isbecoming much more necessary in international financialmarket. However,huge financialrisk determinesthe industry must have a bubble period, the financial crisis in 2008 strongly illustrates this point .In this circumstance, people try to save this industry for make it better, So “how to better establish foreign banks regulation legal system” cause the strong attentionoftheinternationalcommunity. The thesis of mine’s content will start from the basic knowledge of foreign banks’ regulation legal system ,then I will try to analysis the most important guidance, the Basel III.And I will introduce the Chinese foreign banks regulation legal system , trying to compare it with the Basel III, and finding defects on it.
