摘 要 人类不断的自我繁衍，使人类社会得以延续，拥有后代是每个人的权利，也是社会 发展的需要，但随着生存环境的不断恶化，生存压力的加大，婚姻年龄的普遍推迟等因 素的作用下，使一部分人不能实现生儿育女的愿望。但随着人工生殖技术的出现使许多 不孕不育的患者实现了为人父母的愿望，但该技术同其他现代科技一样，是把“双刃剑， 给人类带来福音的同时，也对亲子身份如何认定的问题带来了巨大的冲击。 本文以生育权的伦理基础为突破口，通过对生育权的分析，来证成人工生殖技术是 生育权的延伸，从而在立法上找到正确的定位，最后对人工生殖子女法律地位的保护在 我国的实现提出对策。 本文主要分为四大部分，第一部分是人工生殖技术的种类、历史发展和伦理基础， 这部分着重论断人工生殖技术的伦理基础，从伦理基础入手，说明人工生殖技术存在的 必要性，推导出人工生殖技术不仅仅是一种生育手段，而是传统理论的延伸。 第二部分介绍人工生殖技术对传统亲子身份认定规则的冲击，说明人工生殖技术的 出现以及运用，使传统亲子身份的认定受到了前所未有的挑战，尤其是对现有规则带来 了冲击。即在漫长的人类岁月中，家庭是以血缘关系为纽带建立起来的，亲子关系不会 混淆。但随着人工生殖技术的广泛应用，人类开始面临许多难题。人工生殖技术的适用， 使血缘关系不再受特定时间、空间和辈份、年龄的限制。 第三部分主要介绍国外关于此问题的规定。 第四部分是本文的核心，通过对生育权本质的探讨，来提出人工生殖子女的法律地 位认定规则在我国的构建。 关键词：生殖技术：法律地位：亲子身份：生育权 Abstract Human constant self-reproduction,SO that the continuity of human society，with future generations is everyone’S rightbut alSO social development，but with the worsening living conditions，increasing the pressure to survive，marriage age and other factors delayed the role of general Next，make some people desire to have children can not be achieved．But with the advent of artificial reproductive technology in many infertility patients to achieve the aspirations of parents，but the technology with other modem technology，is the”double-edged sword,”to bring the gospel to mankind，but also on Family issues as how to identify an enormous impact． In this paper,the ethical basis of reproductive fights as a breakthrough，through the analysis of reproductive rights，reproductive technology to permit adult work is an extension of reproductive rights，resulting in legislation to find the right position，the last of the legal status of assisted reproductive technology protection of children in China achieved，to propose a solution． ’ This paper is divided into four parts，first part is the type of artificial reproductive technology，history and ethical basis，thiS part of the thesis focuses on the ethical basis of artificial reproductive technology,starting from the ethical basis，indicating the need for the existence of artificial re
