With the increase of international exchanges, the potential cultural values and the increasingly apparent commercial values of the folk literature and art works cause the increase of the rights dispute of folklore. The legal protection of folklore is getting more and more international and domestic social concerns. In order to promote the works of folk literature and art’s prosperity and make it better development, spread, carrying on the legislation protection is an urgent need, and also is a kind of trend. However, the present legal system of civil protection of folklore has no detailed provisions. The article analyzes the legal protection of folk literary and art works that necessity, by formulating a special law to protect the folk literary and artistic works. Key words：Folk literary and art works; Necessity; Special law; Legal protection UNESCO）和世界知识产权组织（World Intellectual Property Organization，WIPO）共同制定的《保护民间文艺表达免受非法利用与其他损害行为的国家法律示范条款》将保护对象界定为“民间文艺表达”，而1977年《关于建立非洲知识产权组织的班吉协定》将保护对象界定为“民间文艺”，中国《著作权法》中采用的术语为“民间文学艺术作品”。相同的客体在不同的立法、研究等相关文件中之所以用作不同的术语，因为不同的国际组织、不同的国家有着不同的利益需求以及各自的侧重点不同。 突尼斯版权法是最早保护民间文学艺术作品的国家立法，其把民间文艺定义为“由祖辈遗传下来并通过习俗、传统维系的艺术遗产以及民间创作的任何方面，如民间故事、写作、音乐与舞蹈”。1977年的《班吉协定》在在非洲地区以及不少发展中国家具有广泛影响力，其在1999年修改后将文学艺术作品定义为“由某社群或是被该社群认可为体现其传统艺术诉求的个人所发展和传承的传统艺术遗
