中国人民公安大学 毕 业 论 文（设计） 题 目: 对文件检验中相关术语内涵与外延的探讨 学生姓名: 刘思雨 学号 200921120048 2009年级 刑事科学技术专业 刑事科学技术方向 刑事科学技术大队 二 区队 指导教师: 黄建同 教 务 处 制 对文件检验中相关术语内涵与外延的探讨 摘 要： 人类的司法证明活动已经进入了以物证为主要载体的‘科学证据’时代。特别是新刑诉法修订后，确立了非法证据排除规则，证据的合法性也得到了制度的保障和强调。所以，这就更体现作为文件检验提供的证据形式——鉴定意见，兼具着科学性和法律性。然而，长期以来文件检验学的研究大多站在物证技术的角度，缺少从法律角度去看待文件检验的人。这样就导致实务中的文件检验技术人员的鉴定工作往往不能满足诉讼的要求，发挥不了应有的证明作用。笔者的这篇论文，就是从技术和法律的双重视角，来探讨文件检验中的相关术语的内涵和外延，希望给文检学带来不同的声音，给文件检验的理论研究尽一份自己的力量。本论文讨论了“文件”、“可疑文件”、“文件检验”、“文件检验学”、“文书鉴定”等术语，还对文件检验的作用、任务、研究对象、一般原理、常用方法进行探讨，并得出了自己的观点。 关键词： 文件 文件检验 文件检验学 关系 区别 作用 任务 对象 可疑文件物证 文书鉴定 Discussion on the relevant terms in the connotation and extension of document examination Abstract：Human activities of judicial proof has already entered into the evidence as the main carrier evidence era. Especially the revision of the new criminal procedure law， establish the exclusionary rule of illegal evidence， the legality of the evidence has been the safeguard of the system and emphasis. So， this manifests as document examination form of evidence -- the expert opinion， both scientific and legal. However， long-term studies document examination are standing in the material evidence technology point of view， the lack of to look at from a legal point of view the document examination. This led to identification of the work practice of the document inspection personnel are often unable to meet the legal requirements， proof role not due. In this paper， the author， is from the double perspectives of the technology and the law， to explore the connotation and denotation of terms related to test of documents， hoping to bring a different voice to document retrieval， theoretical study to document examination and contribute our own strength.
