本科毕业论文 （2013届本科毕业生） 论文题目：浅议中国企业面临反倾销的原因 及其应对措施 学生姓名： 陈晨 学生学号： 学院名称： 国际商学院 专业名称： 国际经济法 指导教师： 李青 二零一三年五月 摘 要 在日益激烈的国际贸易竞争中，随着“倾销”在出口贸易中的盛行，为了维护正常的国际贸易秩序和公平竞争，反倾销成为了被WTO规则认可的贸易救济措施。但在日益飙升的全球反倾销案件总量中，部分反倾销国家将这一措施用做了贸易保护的工具。根据WTO官方数据统计显示，中国已连续17年成为全球遭受反倾销调查最多的国家，同时中国也是受反倾销侵害最多的国家。在我国政府和出口企业应对反倾销的实践中，如何应对“非市场经济国家”和“替代国”制度所带来的不公正待遇？如何从根本上防患于未然，降低外国对我国的反倾销调查？本文从倾销和反倾销的基本法律问题出发，通过对欧美反倾销法的学习，针对欧美的反倾销调应对提出建议和措施。与此同时，结合对经典案例的分析，理论联系实际，对我国政府及相关部门和应诉企业提出应对措施，进而对上述问题一一做出回答。通过剖析WTO框架下中国企业频遭反倾销的各方原因，从根本上降低我国被控反倾销的可能性，而不止是在案件发生后提出应对措施。 关键字：倾销，反倾销，应对措施，出口企业 Brief-comment on the Causes and Countermeasures of Anti-dumping Faced with Chinese Enterprises Abstract: In the increasingly fierce competition in international trade, with the prevalence of dumping in the export trade, in order to maintain the normal order and fair competition in international trade, anti-dumping has become trade remedy measures recognized by the WTO rules. But in the growing total amount of the word’s anti-dumping cases, part of the anti-dumping countries have made it as a tool of trade protection. According to the WTO official data statistics, China has a larger number in the world’s anti-dumping investigations than any other countries. In the meantime, China is also the country with the largest anti-dumping attack. In the practice of dealing with dumping, how to deal with the injustice that “non-market economy country” bring about? How to defense this situation, reducing the dumping investigation from abroad? The paper sets out from the fundamental legal issues of dumping and anti-dumping, according to the study of Europe and the United States anti-dumping, put out specific measures and suggestions to anti-dumpling investigation.
