中文摘要 在唐代以前的中国历史上，传统中国社会已经形成了包括身份继承及财产继承制度 在内的传统继承制度。这些制度成为唐代继承制度的历史渊源。 作为中国历史上的一个鼎盛时期，唐朝在经济、政治、文化方面遥遥领先于其他国 家，成为了当时世界上最强盛的帝国。唐朝的统治者在继承前代立法成果的基础上，制 定了以唐律为主干，令、格、式并存的完备的法律体系。其立法成就达到了中国封建法 律史上的最高峰。《贞观律》、《唐律疏议》、《唐六典》等对后世的法典编撰均产生了重 大影响，意义深远。 继承制度是唐代法律制度的重要组成部份，唐代在承习此前中国传统继承制度的基 础上，于身份继承及财产继承两个大的方面均建立了比较完备的制度，从而使中国传统 继承制度，发展到一个新的高峰。本文中。笔者在回溯唐代之前的传统继承制度的同时， 以唐朝的法典及传世资料和考古资料为基础，对唐代继承制度的两个大的方面身份继 承及财产继承进行探究，并探索唐代继承制度的的基本原则和历史特点，以期加深对唐 代继承制度建设的历史成就的认识。 全文分引论、正文及结语三个部份。正文部份由三个部份构成。首先，探讨唐以前 中国传统继承制度的历史发展路径，通过对唐之前身份继承及财产继承制度的描述，力 求发现此间继承制度的历史特点。其次，探讨唐代身份继承制度度和财产继承制度的基 本内容，并从中抽象出唐代继承制度的法律原则。正文的最后，在总结唐代继承制度的 历史特点的基础上，重点探讨唐代继承制度的历史成因和社会意义。 关键词：唐代；继承制度；身份继承；财产继承；特点 1 Abstract The Chinese history before Tang, traditional Chinese society had form traditional inheritance system including Identity Inheritance and property inheritance.
