论我国劳动者合法权益的法律保障——以SA8000标准为中心的探讨论文
Abstract
SA8000 (Social Accountability 8000) that social responsibility standards, applies
mainly targeted at business, and protecting the work environment, working conditions, worker
rights as its main content. SA8000 standard based on the International Labor Organization
(ILO) core labor standards, Convention on the Rights of the Child, the Universal
Declaration of Human Rights, and it contains a number of recognized human rights concept
of human society. SA8000 standard applies all companies in the world regardless of all sizes
in any industry and it is a third-party certification body that can be audited to international
standards as the ISO9000 quality management system and ISO14000 environmental
management system .For nearly three decades, although China has established the Labor
Law as the center, supplemented by the Labor Contract Law, Employment Promotion
Law and other legal department of labor law, the violation of workers’ rights and interests of
our country still occur time and time again, and protection of labor rights is also dissatisfied,
which means that Chinese current laws and regulations related to labor law did not play its
due role in the promotion of corporate social responsibility and safeguarding the rights and
interests of laborers . Therefore, this article attempts to find out the shortcomings of Chinese
Labor Law, and then made a number of sound proposals by comparison with the SA8000
standard, so that Chinese enterprises still protect legitimate rights and interests of workers in
the increasingly fierce competition in international trade ,in order to establish a socialist
harmonious labor relations, to achieve social fairness and justice.
