Abstract Abstract AAbbssttrraacctt Parents’right system is an important content of civil law to adjust parentage relations ,and also an essential component of modern parent-child law . Parents’right system is evolved from paternity system.Compared with paternity system , Parents’right system is more characteristics of the times, more in line with the modern legal concept. Our country does not state Parents’right system, but there are a lot of questions related to minors closely in the modern society. For example, some parents often abused their children, give severe corporal punishments, even propel them toward a life of crime. To solve these problems, Chinas current legal blank shows that it is essential to construct Parents’right system .Modern legal system under the context ofParents’right system ,the parents emphasize more about the obligations of parents, rather than ancient paternity system about the children’affiliation with the power of their parents. The present legislation of our country adopt the guardianship system with the absorption of Parents’right system way to standardize the parent-child relationship.Although the two are very similar, but the difference is very obvious. In the contemporary society, the calls of protecting the interests of the minors is growing,itisnecessaryforoutcountrytoestablishtheParents’rightsystem Thepaperisdividedintothreeparts. The first part shows the definition, feature, history of Parents’ Right Attendance and the difference between Parents’ Right Attendance and guardianship. Parents’ Right and guardianship is different,and they have essential difference . Parents’ Right have its own special function in adjusting objects, which can maintain the harmony and stability of the family better. It is of importance to perfect the
