A s tw o im portant sectors of legal system s related to hom osexual fam ilies, legislation of hom o sexual m arriage and adoption by hom o sexual coup les have been given m ost attention by w orldw ide countries in term s of stipulating their hom osexual law s. H om osexual m arriage and adoption by hom osexual coup les are estab lishm ent and im p lem ent of the fam ily of hom osexual coup les. W h ile its difficu lt to accept the hom osexual m arriage in the w orld, out of protection of hum an rights, its necessary to m ake research on hom osexual m arriage on the basis of related fam ily law s by app ly ing other law s related to fam ily to resolve the prob lem s arising from hom osexual fam ilies. T he first part of paper intends to analyze the history of hom o sexual com b ination w h ich w ou ld shape new m ode o f fam ily. W ith the confirm ation o f non- pathological changes for the hom osexual and decline of traditional fam ily s function, it m ak es a reasonab le foundation for em erg in g of new m ode of fam ilies. T he second part and th ird part are to discuss the current legislation of countries in the w ho le w orld, sum m arize the legislating m odes and legislating advantages and shortness am ong variou s m odes according to current legislation s of countries.
