T h e non-conten tiou s m echan ism of judicial interv en tion in corp orate gov ern ance con sists of tw o d im en sion s, sub stan tiv e law an d pro cedural law . In th is th esis, th e w riter analyzes C h inas prob lem s of th e non-contentiou s m echan ism of judicial intervention in corporate gov ernance, and tries to bu ild from th e above tw o dim en sion s. T h is th esis can b e d iv ided into 5 p arts. In th e first p art, th e w riter analyzes th e non-conten tiou s m ech an ism in gen eral. In th e civ il procedural th eories and system s, on the basis of sub stantive righ ts con ten tiou s or not, civ il cases are classified into litigation on es an d non -contentiou s on es, and th ere are litigation procedure and non-contentiou s procedure to m atch . B oth th e n on-contentiou s case and pro cedure h av e ch aracteristics d ifferin g from th e litigation case and procedure. T h e second part illu strates th e leg itim acy of th e non-contentiou s m ech an ism of jud icial interv ention in corporate gov ern an ce. F irst, th e corporate gov ern an ce m echan ism can be d iv ided in to m any typ es. T h e non-contentiou s m echan ism , as on e of w h ich , is an im portant com p lem ent to th e litigation m echan ism , enrich ing and develop ing m eth ods and approach es of jud icial intervention in corp orate governance.
