臺灣鑛業，第 66 卷第 2 期，第 13-23頁，民國 103 年 6月 礦石加工設施與砂石加工設施使用之礦業用地屬性探討 The Study on the Mining Industry Land Attribute of Ore Processing Plant and Aggregate Processing Plant 施 信 宏* * Hsin-Hung Shih 摘 要 目前礦業政策與砂石政策都屬礦業主管機關所管轄，但在行政體系或實場運作上，有其 許多同質或異質性，而礦石加工設施（礦石洗選場）與砂石加工設施（砂石碎解洗選場）用 地，除容許情形外，都應變更為「礦業用地」後使用，外界對於兩者未能清楚釐清，往往造 成誤解或困擾。因此，本文就礦石洗選場與砂石碎解洗選場兩者間之同質、異質性，包括︰ 基本屬性、申辦流程、相關限制等課題，來加以整理分析，清楚說明兩者的法定地位及其相 關屬性，提供給各界作為參考。 關鍵詞：礦石洗選場、砂石碎解洗選場、礦業用地。 Abstract The management of mining industry policy sand and gravel policy are currently governed by Bureau of Mines in Taiwan. However, there are similarities and differences between these two policies in administration and practical operation. The lands of ore processing plant aggregate processing plant are called “mining industry land”, It is so difficult to clarify these two polices that they are often misunderstood by people. The purpose of the paper is to clarify the similarities and differences between ore processing plant aggregate processing plant for reference in various aspects, including basic attribution, application procedures and related restriction, etc. Key words:ore processing plant, aggregate processing plant, mining industry land. 一、前 言 就非都市土地「礦業用地」而言，其容許使用項目計有 8 項，而其中屬礦業主管機關所管轄 之使用項目有︰「礦石開採及其設施」、「土石採取」及「砂土石碎解洗選加工設施」等 3 項，其 行業別分屬「礦業」（第1 項）及「土石業」（第2 、3 項），話說此兩種事業於非都市土地中，除 得容許使用的用地外，均需變更編定為「礦業用地」後，始得使用。僅管實場運作原理或程序上， 兩種事業有相當多的共通點，但由於在行政體系上（包括︰適用法源、權責階層、屬性及管理等） 有所不同，兩者之同質及異質性未經解釋，仍常造成外界混淆或困擾。 102 年 12月 16日收件 103 年 2月 13日受理 *經濟部礦務局技正 (Technical Specialist, Bureau of Mine, MOEA) 。
