General patents jump into standard-essential patens (SEPs) after a variety of rules. The combination of monopoly and un- iversality of general patent and standard could easily put the market competitor into a monopoly position because the economic subjects would consciously or unconsciously exclude and restrict market competition to maximize their interest. The current civil law, contract law, intellectual property law and standardization organization cannot perfectly contract such kind of monopoly behaviors, so at this point, anti-monopoly law is a better choice with its advantages in solving the mentioned problems.
