Unit 9 Complaints, Claims and Settlement In international trade, claims do not happen in every transaction but often occur. Sometimes when the loss is not serious, the party suffered the loss may not lodge a claim for compensation. Instead he writes a complaint to call the other party’s attention to avoiding this matter happening again. Claims are usually raised by buyers for great loss, for example: loss caused by non-delivery or delay of delivery and improper packing, breach of contract, etc. However, sellers may also raise claims against buyer for non-establishment of L/C or breach of contract, etc. 1. A complaint letter usually follows the under mentioned outlines: Begin by regretting the need to complain. Give a detailed presentation of facts to explain what is wrong. State your reasons for being dissatisfied and ask for an explanation. Refer to the inconvenience caused. Suggest how the matter should be put right. Ⅰ. Making complaints 1. To make (lodge, lay, file) a complaint with a department about sth. 因某事向某部门抱怨 The importer has filed a complaint with our corporation about poor packing of the goods. 顾客对你方所提供的货物的质量提出抱怨。 2.To complain to sb, of (about) sth.向某人抱怨 The buyer complain to you about the delay in shipment which has caused us much trouble. 买方因货物的破损向卖方提出抱怨。 3. To be of the quality是…的质量 We regret to complain that your consignment of cotton piece goods shipped by m.v. “Taching” is not of the quality and color of the sample piece. 你方由“大庆”号轮所装的棉匹布的质量与样品布不符,我们遗憾地对此表示不满。 4. To be not up to (measure up to) 达不到 We are sorry to learn that the quality of your shipment is not up to the agreed specifications. 我们很遗憾地发现你方货物的质量达不到所同意的规格。 Your goods are not up to the standards commonly accepted. 你方货物达不到普遍接受的标准。 5. To correspond with (to be in conformity with,to conform to)与…一致 On examination, we find that the consignment does not correspond with the original samples. 检查后我们发现这批货与原来的样品不一样。 6.
